No. 39 | A celebration of democracy

This week, the Cuban people voted to adopt the most progressive Families Code in the world.
Over 66% of voters approved an amendment to the Cuban constitution that legally redefines what it means to be a family, putting an emphasis on love, human dignity, equality and non-discrimination.
The Code goes further than any legislation in the world, not only legalising same-sex marriage, but also guaranteeing the right of all people to form a family in any way they want.
It enshrines in law the right of women to decide about their own bodies, strengthening existing legislation, and securing reproductive rights for all people. Under the Code, parents will have ‘responsibility’ for, rather than ‘custody’ over children; corporal punishment will be illegal; and young adults will enjoy more freedoms. The Code enshrines domestic violence penalties and expands the working rights of full-time carers.
The new Family Code took shape through a participatory process that involved 6,481,200 people, or around 75% of the Cuban electorate. This is a milestone in the advancement of democracy. Nowhere in the world has a family law been submitted for public consultation and subject to a referendum.
How did so many people take part in this process? And how does Cuban democracy work?
It begins with a network of mass organizations, whose roots reach far into communities around the nation. From the Street Committees to the Women’s Federation and many others, mass movements organise community-level meetings for the debate and evaluation of policy. Almost every Cuban belongs to one or more of these organisations, and each organisation has both the power to initiate, and the right to be consulted on, new legislation.
Then there are the institutions of popular power, which operate at the local and the national level.
Cuba has 169 Municipal Assemblies. Candidates for elections to these assemblies are nominated and elected by peers in their local communities: neighbours choose neighbours. People cannot nominate themselves: it is the community that choses. Once elected, each representative holds office for two and a half years, and is subject to a right of recall by voters. For misconduct or poor performance, delegates can be replaced before their term expires. Throughout their term, each municipal delegate continues to live within their community, among those who elected them. They are not paid, so there are no ‘career politicians’.
Then there is the National Assembly, the institution with legislative power in the country. It is made up equally of municipal delegates — chosen in an election that takes place once every five years — and nominated delegates from the mass popular organisations and work-based sectors, cultural institutions and so on.
The direct link between local and parliamentary elections — and the deep connection of representatives to local communities — ensures that the Cuban people have many pathways to participate in thepolitical process of their country.
The new Families Code is a product of this institutional architecture. And that architecture, in turn, is the product of a long and vibrant process of socialist construction — one that offers many lessons for peoples hoping to build democratic projects all around the world as we confront global economic and environmental crises.

Defending Democracy in Brazil
On Sunday, Brazilians vote in presidential elections that see incumbent Jair Bolsonaro face off against former president Lula da Silva. Bolsonaro has stoked fears of electoral fraud and manipulation. He has suggested that the armed forces should replace electoral institutions that are considered among the best in the world.
Bolsonaro said he will only leave office “killed, jailed, or victorious.” Addressing election results in a recent public speech, Bolsonaro declared: “If necessary, we will go to war.” The Progressive International is on the ground observing the elections and standing with the Brazilian people. Fighting lawfare in Argentina
Last Saturday, the Progressive International launched a campaign of solidarity with Argentine vice president Cristina Fernández de Kirchner, who recently survived an assassination attempt, and the people of Argentina. Art of the Week
Mujeres Creando are an anarcha-feminist collective in Bolivia, who take their art to the streets. Through graffiti, street theatre and direct action they address all kinds of oppression from a feminist perspective — racism, dictatorship, sexual rights and debt. They produce a weekly radio show and have a cultural cafe in La Paz.
'It is very important that what we do in the street interacts with people, talks to them so that they can see the graffiti, that it should provoke something in them, provoke laughter, provoke annoyance, provoke anger, provoke many things.’
